All - as an update: KLM processed my request and did a full ec261 comp. Very happy with the result!

If you really want this job you can potentially ask for an additional interview citing the unfairness treatment you got from this one person. It worked for me at Google.

I read the translation of both. His case is different in the sense that he 1. Went to the airport and checked in and has boarding pass to prove; 2. He didn’t book a separate flight on his own and it was the best alternative offered by klm and still resulted in 4 hours of delay.

The cases cleared stated they lost because “Anyone who doesn't show up at all is not entitled to the flat-rate European compensation. The most he could do is try to get compensation from the airline under other laws. The same applies to anyone who takes a replacement flight on their own initiative. Because the only thing that matters is that you have lost time, more than three hours. If the passenger was delayed for less than three hours, he does not have to receive any compensation under European law.”

Still very useful data points tho. I will find a third party resolver service and have them reference this as well…

Ah maybe it wasn’t clear - klm staff rebooked him to the lh since he will 100% be missing the connection… does this make a difference? He preserved all his evidence of original boarding pass etc…

Thanks for your detailed response. And I completely agree with you about the perverse incentives here. I checked with customer service, if he had gone to ams and take next best available connecting flight he would be more 8 hours delayed overall and that would ruin the trip completely. KLM says no eu261 comp if disembarking a super delayed flight? Delays/Cancellations/Compensation

Hubby was on a flight from Stockholm to Amsterdam today (kl1104) and had a connecting flight to sfo. The leg to Amsterdam didn’t take off for 2 hours bc of some ac issues. He def was going to miss the connection because the layover was only 80 mins. I helped hubby call klm customer service to rebook to a diff Lufthansa flight to sfo via Frankfurt and he had to get off the plane. The captain said if he get off he would lose ec261 comp rights. Does that sound right? I read the regulation didn’t see that being mentioned.

The rebooking was offered by klm when I callled and he did take that option. But overall he was more than 4 hours delayed to final destination in sfo. Is he still entitled to ec261?

[update]: klm processed the request and granted the comp without any back and forth. Very pleased with the outcome! Although i got some outreach from Reddit fake klm customer service account who are actually scammers from Africa. Be aware!!

Thanks & hope you get yours soon too. It took around 90 days for me and it seems like they’re approving eb2 at very fast speed. I think that’s called changing attorney of record. I didn’t look into doing that but my husbands derivative aos was still pending when I left my job and the old company attorney was very nice and reassured me that they will help out with his case / rfe if any till the end… even if I switch job… I read lots of Reddit posts.. it seems like for a lot of ppl you don’t have to do anything and the aos will just continue to be adjudicated and approved… my husbands also just got approved fine.
