You can but it's up to you if you want to challange them for taking your property with no timeline for it's return, for breach of your privacy too (i.e. they can't hold or process your phone/data indefinitely), etc. If you sent a solicitor's letter, then you'd probably get an update quickly. I've taken on similar cases and they magically resolve themselves after threatening legal action.
Write a letter to Superintendent of the Garda station (if you know it, if not to Garda HQ) requesting your phone back within 14 days or you'll get a solicitor to issue proceedings.
