Can someone please help me? One of my coworker is harassing me (name calling ,snarky comments etc) when no-one is around .It's an ongoing issue the least more than 3 months and HR won't do anything because "there are no witnesses ".I don't know anymore what to do but the situation is really bad . Of course the coworker denies any wrongdoing and saying I'm the one who is a bully -I've never reacted to her abuse always walked away and let the management know about the situation every time when it's happened . I don't know what else I can do apart from emailing to the HR .(I'm working in retail)

no its not. one party consent in ireland. your an employee being harrassed by a colleague so your also doing it to protect yourself, its up to the judge to throw out the recording as evidence and if hr have a problem with the recording then 100% go to the WRC. because fuck em (HR)

I know someone who got in as much trouble as the bully for recording without consent, but that was ten years ago so things might have changed!

also just to protect yourself, as HR sound like a bunch of assholes, i wouldnt go off running into them saying "hey i have a recording"
I think you should first get a recording of the bullying in work and the phonecall if you can (maybe try the phonecall after you first have a recording of the bullying in work)
Then walk into HR (also recording) and again make your complaint, and this time ask them if you can record the incidents. - they either say yes and you can say okay thanks. Or if they say no, you now also have them on the hook.
Then straight to the WRC

To be fair, it’s a lot more nuanced and complex than simply going to the WRC after HR decline to hear the recording. I’m always wary of advising users like OP about jumping straight to litigation when they haven’t laid the necessary groundwork to build a case.

Yes, but assuming we are talking about constructive dismissal here, the recordings alone will be nowhere near enough to land the claim.
Case law sets an extremely high burden of proof on employees to claim constructive dismissal, including evidence that they exhausted all internal HR processes. If OP meets one simple setback with HR, that’s not exhausting the process - it’s crying foul and prematurely skipping to resignation.
Instead, OP should file a written complaint with HR asking specifically for them to investigate under the dignity at work policy, and to indicate that she has recordings available as evidence. OP should then see where the process goes, and if necessary resign and claim constructive dismissal but only after going through the full process and allowing HR to run out of chances to get themselves out of a bind.
The idea of just resigning after facing one obstacle and claiming constructive dismissal is extremely foolhardy and makes my job (as a lawyer who represents employers) much easier.
One other thing, make sure you use your personal device and not a company one. HR can take any company devices and do what they want with it. Remember hr is there to protect the company

It’s not in everybody to do it, but, have you confronted the person and firmly but politely told them to leave you alone?
There’s always one bully in every job and I’m a shy person but I’ve honestly had a 100% success rate with that method, bullies tend to back off once they realise they that you’re going to be bullied. They tend to pick more on the people who don’t say anything back.
I did -couple of times .Unfortunately she is not willing to listen to anybody .She goes quite for couple of days and starts again .

If there is one, there should be a "bullying/harassment policy." It might be worth asking HR if there is a HR department.
NAL, I don't know the correct course of action. But document everything including your interactions with HR and especially your interactions with the other individual. Times and dates etc , for your own record
