can I sue my local council for poor treatment? I’m based in England

Long story short I made a post yesterday about my parent being falsely accused of fly tipping https://www.reddit.com/r/LegalAdviceUK/s/XcXUuMn8C0 And I’m wondering if we file some sort of lawsuit considering we’re renting a council flat along with the amount of bs we’ve been put through

They don’t collect the bins for a month or more
6 households are having to share 5 bins (we aren’t even given any recycling bins)
Cleaner which is hired by the council fly tips (see other post for more detail)
I’ve found CCTV from the local shops of the actual public bin so we can easily prove it now
Council are basically accusing us of fly tipping now even tho we didn’t.
I also found out the exact same situation is happening to my neighbour.

I’m just curious because the block of flats has been putting up with this type of treatment for years and it’s not the first time we’ve had to deal with an issue like this

I feel there’s some sort of gross negligence for the residents due to lack of bins, lack of waste collection and issuing fines due to the mistakes of workers hired by them

I feel like you might have more luck with the Local Government Ombudsman. But councils are very adept at avoiding blame. Good luck.

You don't have any legal basis for damages. Your only recourse is to complain to the council and ultimately the Local Government and Social Care Ombudsman. You could also hound local councillors about the predicament.

In relation to the allegations of fly-tipping, you should go through the internal appeals procedure and ultimately contest it in court if you are confident in your defence. If you have footage of the council staff or cleaning contractors fly-tipping on CCTV, it's an open-and-shut case.

It is your duty of care to dispose of your waste correctly. You could be fined an unlimited amount by your local council if your waste ends up fly-tipped, and you cannot show that you took reasonable steps to prevent it. If convicted at court, the maximum fine is unlimited and you could face 5 years in prison.

What would that entail for someone whose council takes away council trash too infrequently and does not provide an adequate number of receptacles?

If you read the last post u can see we did dispose of it correctly but the cleaners hired by the council have instead taken the rubbish out of the bins and moved them outside
