My mom has 1/3 share of a house. So does my aunt. They desperately want to sell it and have felt that way since the passing of my grandmother.
My uncle is the other third. He’s a real estate investor and he wants to, at some point, fix it up and make some money on it.
That’s the “plan” but no action is ever taken and the property just sits vacant year after year.
Neither my mom nor my aunt care about that at all. Besides him simply buying them out, is there anything they can do to force his hand?
They can file a partition suit to force the sale. Sometimes just beginning this process is enough to get the other person to realize that a sale is going to happen one way or the other. That spoils see an estate planning attorney to find out hire it works and then if they want that attorney can contact your uncle and tell him what’s going to happen if he doesn’t agree to sell - and that’s that a judge will force the sale.
