My wife and I moved to Texas with hopes of fixing our marriage. It’s not working. She cheated on me a year ago and its still hard to deal with today. Will a divorce in Texas be “more fair” than in California? I work, she doesn’t. I have an 11yr (soon to be 12) and 13yr (soon to be 14). How would alimony work? I take home about 190k/yr.
Texas is better for high earners and I’d think you’d fall into that category.
Texas will be a good place to get divorced. You can negotiate just about anything you want with your X. If you can get 50/50 parenting time and you can even pay reduced child support based on the difference of what each would pay if one was awarded more parenting time.
Georgia has at fault divorce so if you prove cheating she gets NO ALIMONY
Yes! A divorce will be more fair in any other state possible than California, New Jersey, or Massachusetts.
So yes! Get divorced in Texas!
Texas will require that she either get a job, or get an imputed income based on her abilities, but set to a minimum of "minimum wage 40 hours".
California will say, "awww. You're so mean! Forcing her to try to get a job! She's too sick to work, even if she doesn't qualify for disability. You have the ability to work 2 jobs to support her, so she doesn't have to work."
You forgot illinois
Fuck, I’m in Massachusetts.
She doesn’t work and I do. How would that hypothetically work?
You’re fucked. Another blue state that has divorce laws which are 100% anti male.
Be prepared for the WORST. That's all I can say. And yes, Lawyer up.
😬😞
You unwittingly did THE best thing for yourself by moving to TX.
Definite yes, some users have pointed out that e-file option is available in Texas now! So it should be a simple matter of filing out forms and negotiating with ex
Texas is wayyyyyyy better for you. Alimony (spousal support) is very limited here. Child Support goes right off the calculator. You just plug in your monthly gross income, health care monthly cost, and dental care monthly cost. Just google texas family law child support calculator
Additionally Texas has a cap on child support which OP is over if he has 190k take-home. CS cap is hit at roughly $140k gross/yr.
Id have her get a job asap, stay at home wife is going to get alimony and cs
Just about anywhere is better than California. But it's a matter of degree, unlikely to be some massive win.
Texas is WAY better! CA has lifetime alimony. And her not working would absolutely fuck you over.
