When you use a visa, you can stay for up to 6 months and potentially change status in the US. If you use ESTA, you can stay for 3 months and cannot change your status in the US.
Iโve recently come back from the Romanian Consulate in London to try and obtain a visa for Romania for my partner. Hopefully we can go this July. Sadly she is only eligible for a 2 year USA visa..ย
Where is she from? Romania has joined Schengen, only for sea and air travel, but Romania can issue Schengen Visas now. If she has a Schengen Visa, she can come.
Because they need to first have 90 days visa free for USA, have a biometric passport, share all criminal data of all citizens in an instant background check like format, then their overstay rate has to be low (less than 2% ILLEGALLY yes you can overstay if you adjust status), finally have less than 3% refusal rate for visas overall (not sure of immigrant vs non immigrant visa).
