Flaired Users OnlyI don't think this is a great gotcha. The DA's job is to prosecute based on the law as it is, not to pick and choose which laws matter. Too many democrat DAs do that now and it's causing havoc in their cities.

Like here in NYC, there's pretty much no repercussions for stealing a couple hundred dollars worth of stuff every day because they don't ever prosecute below $1000 and even then it's rare until it's a lot of money.
The problem is Democrats act like it never happened, you would think someone who cares that much would apologize or at least acknowledge that it happened.

DAâs have a ton of discretion and leeway with most crimes, particularly low level non-person crimes such as this.

Youâd think they but there are many loopholes around it. Prosecutorial discretion is very much a thing and DAs will happily reduce charges to get around laws they disagree with. Some offices flat out will not be involved with misdemeanor offenses and make the PDs do the prosecutorâs job.

DAâs do have âprosecutorial discretionâ over the types of cases they want to pursue though - as X correctly points out Harris was never shy about going after weed smokers when she was DA.

Lol, dude DAs 100% pick and choose what gets prosecuted. Way it works is local LE will have to chum up to the DA if they want them to take charges from said agency on particular crimes, if they won't LE won't even bother hooking people up on those charges. Ideally, you're right. We all know how it really works though.
